Disputes Involving Claims of Fraud and Negligent Representation

Fraud and negligent misrepresentation litigation often involves individuals or companies that have entered into agreements or legal relationships based on alleged false statements. Transfers of real estate, transfers of business interests and distribution of estate are frequently the subjects of such disputes.

Peter Schillinger and Lori Finsterwald have achieved a reputation for obtaining excellent results in complex fraud and misrepresentation cases. In such disputes, we represent real estate purchasers, real estate investors and developers, estates, estate beneficiaries, businesses, banks, families and professionals.

Forgery Lawsuits

We have also handled many cases involving documents containing alleged forgeries (fake or phony signatures). We have litigated forgery claims in partnership disputes, guardianship proceedings, mortgage foreclosure cases, and real estate and contract cases.

When there is a claim of forgery, we work with forensic experts who evaluate handwriting and signatures on challenged business agreements, deeds, mortgages, partnership agreements, guarantees, corporate documents and LLC instruments.

In addition, we have defended parties in cases where there were false allegations of forgery. In one matter, we successfully defended a company by proving that the plaintiff had actually signed multiple agreements, including a mortgage, which she falsely claimed were forged.

Incompetence, Undue Influence and Breach of Fiduciary Duty

We have broad experience handling cases involving allegations of breach of duty by a person in a legally recognized position of trust. These cases can arise when such person:

  • Fails to act in accordance with his legal obligations
  • Wrongfully manipulates the affairs of another person
  • Takes advantage of an individual who lacks the mental capacity to understand or protect his or her interests when signing an agreement, a deed, a will or other instrument

In these cases, the law may provide a basis for compensation to the wronged party and certain signed documents may be challenged in court. We have represented both plaintiffs and defendants in these types of cases in the courts of New York.
