In this fraud action, family members breached a duty of trust and issued a fraudulent deed by which they which attempted to convey away our client’s rights to an apartment building.
We obtained a preliminary injunction prohibiting defendants from selling the building and prohibited them from mortgaging the building during the pendency of the case. Thereafter, we obtained an affirmance by the Appellate Division which upheld the injunction.
